INFERRED CLAIM AND NEHMER SEARCH The inferred claim is one that is noted during the adjudication of another issue and VA should initiate the claim just as if the veteran had done so. No, there was no reason VA would have learned of your condition during a "Nehmer search" since Nehmer only applied to veterans who had filed IHD claims and been denied. If you didn't filea claim
LUNG CANCER RESIDUALS Lung cancer patients are often short of breath. Shortness of breath creates anxiety, sleeplessness, panic attacks, irritability and more. Home oxygen therapy is an easy and cost effective solution for all those problems. The veteran who is prescribed home oxygen therapy is usually continued at 100% rated for the duration of the home O2therapy
VA 30% DISABILITY FROM AGENT ORANGE; NOW IHD VA has a unique way of rating our heart disease if we are eligible for service connected ischemic heart disease or IHD. The degree of damage to the heart from IHD is a measurement of how efficiently the heart works. Even if you've had a dozen stents and a number of surgical bypasses, if your heart still works efficiently, the final rating will VIETNAM VETERAN VS. VIETNAM ERA VETERAN The Vietnam Veterans of America group recognize, welcome and label anyone who served during the Vietnam era as a Vietnam veteran. Groups like VFW won't accept us since we didn't serve in a combat zone where most who were in country were subjected to the hazards of war. Like you, I served in Germany during the Vietnam era and I've always called NEED A LOCAL DOCTOR FOR A NEXUS LETTER In other words, you contact the doctor and agree on a service, you mail the records along with whatever the fee you agreed to is, and the doctor reviews and writes an opinion for you to use in your claim. VIETNAM ERA VETERANS AND VA HEALTHCARE Jim's Reply: Many years ago every veteran was given free health care for life. In the era during 2006-2007, the rules changed and eligibility for health care became much more restricted. Today you must have a service connected disability rating or be eligible for pension to receive VA health care. The rating may be 20%, 40% or 60% and is usually in line with how many pads you use each day to control leakage. Don't forget to file a separate claim for erectile dysfunction, a common problem after prostate cancer treatments. SERVICE CONNECTED CANCER IS AUTOMATICALLY RATED AS 100% ON Reply: Any service connected cancer is automatically rated as 100% on a temporary basis. Then, once the cancer is successfully treated, there is presumed to be no more cancer. Thus, if the veteran doesn't have cancer, he can't be rated at 100% for a cancer. After treatments for cancer are completed, VA then will conduct a C & P exam to WILL MY TDIU VETERAN BENEFITS SHOW UP AS THE SCHEDULAR Jim's Reply. The TDIU veteran is awarded exactly the same benefits as the schedular rated veteran. The 100% rating is 100% no matter the underlying details or base ratings. State property tax benefits as well as others like CHAMPVA are usually based on not only the 100% award but whether or not the award is permanent (no future exams) or WELCOME | STATESIDE LEGAL StatesideLegal keeps you up-to-date on the latest resources posted to our site. The obvious first step is to learn who your federal senators in your state are and consider which one you may work best with. Then sort out who your federal Congressperson is and consider which of these 3 you would rather try to work with. This is important at the start of your mission because these offices don't like to overlap in their efforts.C & P EXAM?
