THE RIGHT TO A HEALTHY AND SUSTAINABLE ENVIRONMENT The right to a clean and healthy environment was left out of the Universal Declaration of Human Rights (and therefore the two Covenants) because it was drafted before the advent of the modern environmental movement in the 1960s and 70s. A ROUGH GUIDE TO THE HUMAN RIGHTS TREATY BODIES The Universal Declaration of Human Rights elaborated upon the idea of ‘human rights’ as derived from the United Nations (UN) Charter . The Declaration enumerated a variety of civil, political, economic, social and cultural rights, that were subsequently separated and incorporated into two binding treaties – the International Covenant on Civil and Political Rights (ICCPR) and the HUMAN RIGHTS NORMS: IT’S THE IMPLEMENTATION, STUPID The development of international human rights norms has been one of the great success stories of the UN. The first major achievement was the adoption of the Universal Declaration of Human Rights by the General Assembly on 10 December 1948 – “a common standard of achievement for all peoples and all nations”. ENVIRONMENTAL HUMAN RIGHTS DEFENDERS According to the UN Special Rapporteur on human rights defenders and various international NGOs, environmental human rights defenders (EHRDs) are a group of growing importance and a group at particular risk. Yet little is understood about them, about the particular challenges they face, or about how the international community might best support them. So far, high-income countries have recorded the most cases and deaths, but the economic impact of Covid-19 has been disproportionately harmful to lower-income countries, where governments and citizens have fewer resources to weather the storm. NO MORE PROCRASTINATION ON CLIMATE CHANGE, SAYS GERMAN CONSTITUTIONAL COURT IN LANDMARK DECISION _ by Anna-Christina Schmidl, Universal Rights Group Geneva _ On 24 March 2021, the First Senate of the German Constitutional Court (Bundesverfassungsgericht) rendered its long-awaited decision on four constitutional complaints brought in relation to Germany’s Federal Climate Change Act (Bundes-Klimaschutzgesetz) of 2019. The plaintiffs – some of whom are young climate activists – had alleged, in part, that the Act violates the fundamental rights of future generations by failing to prescribe in sufficient detail a long-term pathway for reducing greenhouse gas emissions by 2050.
