On 29th of January 2021, the Statutes Amendment (National Energy Laws) (Penalties and Enforcement) Act 2020 (the Act) commenced. The Act amends the National Energy Laws by increasing the maximum penalties that a court may order after a finding of a breach of a civil penalty provision and also provides the Australian Energy Regulator (AER) with new enforcement powers. NATIONAL ELECTRICITY RULES The National Electricity Rules govern the operation of the National Electricity Market.The Rules have the force of law, and are made under the National Electricity Law. Copies of the National Electricity Rules are available for inspection at the AEMC's office in Sydney. ACCESS, PRICING AND INCENTIVE ARRANGEMENTS FOR DISTRIBUTED On 7 July 2020, SA Power Networks (SAPN) submitted a rule change request seeking to amend the National Electricity Rules (NER) applying to the economic regulation of distribution network service providers (DNSPs) in the National Electricity Market (NEM). The proposed amendments may also require consequential changes to the National Energy Retail Rules (NERR). On 29th of January 2021, the Statutes Amendment (National Energy Laws) (Penalties and Enforcement) Act 2020 (the Act) commenced. The Act amends the National Energy Laws by increasing the maximum penalties that a court may order after a finding of a breach of a civil penalty provision and also provides the Australian Energy Regulator (AER) with new enforcement powers.METERING | AEMC
Meters are your retailer’s responsibility Under the AEMC’s Competition in metering rules, which started in December 2017, all new meters must be advanced or ‘smart’. Introducing competition in providing advanced meters helps put downward pressure on the cost ofthese services.
CONSUMER PROTECTIONS IN AN EVOLVING MARKET On 30 June 2020 the AEMC published the 2020 Retail energy competition review. As part of this, the Commission published its final analysis on consumer protections in an evolving market. REGULATORY SANDBOXES The Australian Energy Market Commission has published further advice to the COAG Energy Council (Council) on rules to implement regulatory sandbox arrangements in the national electricity and gas markets.. A regulatory sandbox is a framework within which participants can test innovative concepts in the market under relaxed regulatory requirements at a smaller scale, on a time-limited basis and NATIONAL ENERGY OBJECTIVES There are three objectives which govern and guide the AEMC in all of its activities under the relevant national energy legislation. National energy objectives The National Electricity Objective (NEO) The National Electricity Objective as stated in the National Electricity Law (NEL) is:LODGE A SUBMISSION
Any individual, group or organisation can lodge a submission on an open rule change request, or review, with the AEMC. While we endeavour to have regard to submissions received after the closing date, we cannot guarantee they will be given equal consideration to on-timesubmissions.
