The homemade Will in question was signed by the Testator and witnessed but yet the validity is still being contested due to it not being stapled THE RESIDENCE NIL RATE BAND Prior to the election earlier this year, a key promise in the Conservative Party’s manifesto was an increase in a married couples’ “nil rate band” (the amount they can ultimately pass to their children or others free of inheritance tax ) from £650,000 to 1 million. The Party had picked up on the fact that the nil rate band hadn’t kept up with house price increases which were INHERITANCE TAX PAID EXCEEDS £5BILLION The payment of £5.1 Billion in the tax year 2016/17 is a rise of 9% on the previous year, when £4.7 Billion was paid to HMRC. Although the amount of inheritance tax being received equates to just 0.25% of Gross Domestic Product, it is nevertheless an easy tax for HMRC to

collect.

AVOID PAYING CARE HOME FEES With the average nursing home fees now costing around £1,000 a week the question of paying for care in old age has become an increasingly hot topic. A common question I get asked is ‘If I give away my Assets, will the Local Authority pay my fees?’ Giving away assets to your children or other relatives may seem like a g ARE YOU HEADING ABROAD THIS SUMMER WITH YOUR CHILD? DON’T Its a well known fact that lots of parents do not share the same surname as their child and travel without their child’s other parent. There are a number of things which a Court will be looking for when it considers whether a testator was capable of making a Will. Firstly, the testator must have had the requisite mental capacity to make a will. Second, they must also know and approve the contents of that Will. ARE CHANGES TO THE INTESTACY RULES COMING? I read this week that there is another new initiative to try and reform the laws of intestacy to include cohabitees. The law of intestacy sets out what happens to someone’s assets if they do not leave a Will.
