An external examination covers a law practice’s trust records from the beginning of April to the end of March in the following year.

The amount a law practice must deposit into the above statutory deposit account must be calculated in accordance with Clause 10 of the Legal Profession Uniform Law Application Regulation 2015.To help law practices easily calculate this amount, the Trust Accounts Department has developed an online Statutory Deposit Calculator. Applying for probate. Probate is a court order which confirms a will is valid and that any executors have the right to administer the estate. Before you even apply for probate you will need to publish your intention to do so on the Supreme Court website. Fourteen days later, you can apply for probate by lodging the right forms at the Probate Registry of the Supreme Court. PRACTICE STRUCTURES

Unincorporated Legal Practices. An Unincorporated Legal Practice (ULP) is a partnership or an unincorporated body or group that satisfies the criteria set out in the definition of "unincorporated legal practice" in s 6 of the Uniform Law. Similar to an ILP, before a ULP, may engage in legal practice in NSW as a law practice, it must give the Law Society at least 14 days written notice in the PRACTICE MANAGEMENT COURSE Condition 3 is a discretionary condition imposed pursuant to s 53 of the Legal Profession Uniform Law (NSW) and Rule 16(b)(ii) of the Legal Profession Uniform General Rules 2015.If a practising certificate is subject to this condition, the holder must complete a Practice Management Course (PMC) before being eligible to practise as a principal of a law practice. SUPERVISED LEGAL PRACTICE The requirement. Section 49(1) of the Legal Profession Uniform Law (NSW)(Uniform Law) imposes a statutory condition on a practising certificate issued by the Law Society's Council requiring the holder to, in this jurisdiction, engage in supervised legal practice only, until the holder has completed the period of supervised legal practice

required.

COSTS - USEFUL FORMS - PRECEDENTS Ensure you comply with mandatory disclosure requirements. To help your law practice comply with mandatory disclosure requirements, the Law Society’s Costs Committee has set up the forms in appendices 1 - 2 in Microsoft Word which you can customise with your firm’s and client’s data. PROBLEMS WITH THE NEIGHBOURS A person can complain of nuisance if damage is caused by a substantial and unreasonable interference with the private right to use and enjoy one’s land. For it to constitute a nuisance, the relevant activity must not be trivial or unreasonable. Examples of nuisances may include noisy animals, loud air-conditioners and interference with drainage.
