TRIBUNALES DE USA

En la ciudad de Houston, Texas la empresa Harvest Natural Resources Inc. ha introducido una demanda en contra de Rafael Ramírez, Eulogio del Pino, Juan José Mendoza García (PetroConsultores) y José Ángel González Acosta por el delito de intento de extorsión en su

contra.

Estas demandas no fueron hechas una sola vez sino en cuatro ocasiones separadas, siempre en nombre de Rafael Ramírez, por conducto de Mendoza García. Los intentos de extorsión se produjeron en reuniones de Mendoza García tanto con la empresa que deseaba vender, Harvest, como con las empresas que – en su momento – estuvieron dispuestas a comprar, PERTAMINA (Indonesia) y PETROANDINA. Tanto los ejecutivos de Harvest como los de las empresas potencialmente compradoras dan testimonio de que tales reuniones ocurrieron. Tanto la empresa demandante como los potenciales compradores de las acciones de Harvest en PetroDelta S.A. rechazaron, en cada ocasión, el intento de extorsión a quienes lo pedían y, por tal razón, PDVSA y el Ministerio pusieron trabas imposibles de satisfacer por las empresas, convirtiendo lo que pudo haber sido una venta por unos U.S. $725 millones a la empresa PERTAMINA en una venta a un diferente comprador por U.S. $255 millones, venta que solo fue posible una vez que Ramírez abandonara el Ministerio y PDVSA. Esto representó para Harvest una pérdida de U.S. $470 millones. La empresa Harvest pide una compensación del triple de sus pérdidas, lo cual representaría unos $1450 millones a ser pagados por los demandados, más los costos procesales En su demanda Harvest detalla las fechas y asistentes a las reuniones y da fe de que tanto las empresas PERTAMINA como PETROANDINA recibieron pedidos similares de dinero para que la venta pudiese llevarse a cabo. La demanda añade numerosos detalles según los cuales Ramírez y sus “colaboradores” estarían sujetos a investigación en USA y en otros países, incluyendo algunos de sus asociados más cercanos ya  enviados a prisión, como Rafael Reiter y Nervis Villalobos. Po su parte Eulogio del Pino está aparentemente en prisión en Venezuela. En 2015 el Wall Street Journal reportó actividades de extorsión a contratistas españoles por parte de Rafael Ramírez, a través de su primo, aparentemente en prisión en Venezuela, Diego Salazar Carreño,

MARTES, 13 DE AGOSTO DE 2019 NOS DIJO ADIÓS ANÍBAL R. MARTÍNEZ  GEÓLOGO E HISTORIADOR

VENEZOLANO

Aníbal R. Martínez acaba de fallecer. Fue un gran geólogo y un gran historiador del petróleo venezolano, tan versátil como lo fue su gran amigo Humberto Peñaloza. Gran amante de la música, activo defensor de los derechos petroleros venezolanos  en sus numerosas escaramuzas con los Estados Unidos y, en especial, en el interminable  debate con Guyana sobre los recursos petroleros del Esequibo. Fue el mejor historiador petrolero que hemos tenido, no solo por la cantidad sino por la calidad de sus obras. En efecto, Aníbal Martínez publicó 19 libros sobre el petróleo venezolano. De esos libros se han hecho 42 ediciones en varios idiomas: Cronología del Petróleo Venezolano; Historia petrolera en 20 Jornadas; Banco de Piedras; Recursos de Hidrocarburos de Venezuela; La Diferencia con Colombia; Una Política Energética; El Camino de Petrolia; Gumersindo Torres; Diccionario del Petróleo Venezolano; La Faja del Orinoco y otros. Además publicó unas quince monografías y unos 160 trabajos técnicos.  Fue una producción inmensa, doblemente meritoria, porque estuvo esencialmente enfocada hacia el tema del petróleo venezolano. Aníbal Martínez se graduó de geólogo en la UCV en 1949 y obtuvo su maestría en Stanford, California, en  1953. Trabajó con Creole en Venezuela y en los laboratorios de Producción de Jersey, en Tulsa, Oklahoma, en 1958-1959. Desde 1959 en adelante estuvo en el sector privado y en la administración pública, como asesor del Ministerio de minas e Hidrocarburos, en la OPEP en Ginebra, como diplomático y consejero de energía en la década de 1960, en CONICIT y OLADE en las décadas de1970 y 1980. Fue Director del Frente Pro-Defensa del petróleo desde 1964 y su presidente desde 1994 hasta la fecha. En el sector académico, Aníbal fue  profesor de la Universidad del Zulia, en la facultad de Post grado de la Universidad Simón Bolívar, en la Universidad Central de Venezuela y en la Universidad de Keele, en Inglaterra.  Fue Presidente de la Sociedad Venezolana de Geólogos, 1987-92. Presidente de la Fundación Aguerrevere, del Colegio de Ingenieros de Venezuela CIV, 1994-99. Presidente, Sociedad Sinfónica de Maracaibo, 1958-1960. Fundador, junto a Humberto Peñaloza, de La Emisora Cultural de Caracas, 1975. Coordinador General, Programa Música para Bolívar, Corpozulia, 1979-1984. Asociación Pro-Venezuela: Director, 1994-97. Presidente, 1993-1994. Presidente Consejo Consultivo, 1994-1997. Miembro de la Sociedad Venezolana de Ingenieros de Petróleo, SVIP, de la Asociación Norteamericana de Geólogos Petroleros AAPG (Honorario), de la Sociedad de Ex-Alumnos de la Universidad de Stanford (por vida), del Instituto del Petróleo IP Gran Bretaña (Fellow), de la Asociación Internacional para la Energía del Hidrógeno IAHE (Fundador), Asociación Internacional de la Historia de la Geología, INHIGEO, de la Sociedad Internacional de Ingenieros de Petróleo (EUA) SPE. Miembro, SPE, Comisión Petróleo y Gas y Comisión Europea de las Naciones Unidas, Grupo de Expertos para la Clasificación de Recursos de Hidrocarburos. Miembro Fundador de la Academia Nacional de la Ingeniería y el Hábitat, Sillón XXXIII. Aníbal fue una autoridad mundial en el campo de la definición y reglamentación del concepto de reservas de hidrocarburos.Fuímos colegas y amigos, a distancia. Trabajamos juntos en la creación de la orquesta Sinfónica de Maracaibo y en algunas de las actividades de la Sociedad Venezolana de Geólogos. Era un hombre cordial y apasionado en la defensa de sus ideas, culto y de gran capacidad de trabajo. Fue uno de los geólogos venezolanos más importantes del siglo XX. Su contribución a la historia del petróleo en Venezuela ha sido fundamental y su libro sobre la cronología del petróleo venezolano es fuente obligada de referencia sobre la historia de los hidrocarburos en Venezuela.

PATRIOTISMO, SÍ. PATRIOTERISMO NO. En Venezuela la noción de patriotismo siempre ha estado a la vanguardia de las virtudes venezolanas. Hablamos de la necesidad de ser honrados, humanos, solidarios, desinteresados, responsables y de tener muchas otras cualidades, pero la referencia al patriotismo siempre está entre las primeras. Probablemente esa característica esté reforzada por el papel que han jugado los venezolanos en la lucha por la independencia de otros países latinoamericanos. En países vecinos  nuestros equipos deportivos son frecuentemente denominados los “patriotas”. Parece ser que el concepto de amor por la patria está particularmente arraigado en nuestra cultura. El patriotismo es un concepto esencialmente positivo. Nadie puede objetar el sentir amor por la patria que nos ha visto nacer, donde ha transcurrido la mayor parte de nuestras vidas. Muchos de los momentos vividos han sido de felicidad o de tragedia colectivas y los hemos compartido con nuestros compatriotas, lo que refuerza nuestro sentimiento de pertenencia a una gran familia. Ganar una serie mundial de béisbol amateur todavía es celebrado en Venezuela como un momento glorioso de nuestra historia. ¿Quién no recuerda al “Chino” Canónico o a Benítez Redondo? Cuando el deslave de Vargas todos los venezolanos lloramos juntos. Los certámenes de belleza nos dieron ocasión de regocijarnos.  Nos sentimos orgullosos de los éxitos de nuestros compatriotas en el exterior. Cerramos filas en solidaridad con las víctimas de terremotos y otras debacles de la naturaleza en países hermanos. Reímos y lloramos juntos. Esa es mucha de la esencia del patriotismo. Ser habitantes de un hogar común, además de reconocernos como familia. Rara vez me equivoco al ver un atleta en la televisión  al decir: “ese es venezolano”. Y si habla, más rápidamente todavía lo identifico. Sentimos el triunfo de un venezolano que es ahora presidente de MIT como nuestro. O decimos de Cruz Diez: ese fue un gran venezolano. O de Gallegos: Ese fue nuestro presidente y nuestro mejor novelista. Tenemos amplias razones para sentirnos orgullosos de muchos de nuestros compatriotas. Somos una gran familia, no hay dudas. Y ello hace del patriotismo, casi, un sinónimo de amor por la familia. Es hermoso sentirse miembro de la gran familia colectiva venezolana. Estas reflexiones también me llevan a otras consideraciones sobre patriotismo que pudieran diferir de la tradicionalmente manejada en

Venezuela.

�Cuál es mi noción de patriotismo? 1.    Patriotismo es el amor por la tierra que me vio nacer. No solo por nuestros paisajes sino, más importante aún, por la gente buena, sencilla y cordial que hemos llegado a conocer y a tratar durante nuestra vida. En este sentido, el patriotismo es un concepto estrechamente enlazado con sentimientos de solidaridad 2.    Patriotismo  es hacer todos los esfuerzos posibles, como miembro de una gran familia, para que el país Venezuela llegue a ser una sociedad civilizada, humana, solidaria, democrática y libre 3.    Patriotismo es tratar de incorporar a nuestro terruño a la comunidad de sociedades que hacen posible que sus miembros disfruten de una vida mejor, a través de los adelantos tecnológicos y

científicos,

4.    Patriotismo es conciencia de que somos miembros de una sociedad global, con oportunidades y amenazas y de que la defensa de esa sociedad global debe prevalecer sobre cualquier objetivo parroquial. Los seres vivos, desde las hormigas hasta los seres humanos, hemos aprendido que la supervivencia de la especie tiene mayor jerarquía que el logro de los objetivos individuales. En este sentido el verdadero patriotismo trasciende la búsqueda de una ventaja tribal y debe ser  definido como el logro del bienestar colectivo,  de nuestro planeta. En última instancia nuestra patria es La Tierra, más que las entidades político-territoriales en las cuales ese planeta está dividido y las cuales han ido cambiando a través de los siglos. Por todas esas consideraciones me desligo de la tradicional actitud de muchos compatriotas, quienes dicen que todo lo que le dé ventajas a  Venezuela tiene que ser lo deseable, como, por ejemplo, llegar a producir 10 millones de barriles de petróleo pesado de la faja del Orinoco, con todo lo que ello significaría en términos de asalto al ambiente del planeta, el cual ya está seriamente amenazado de muerte. O, por ejemplo, perdonarle a Daniel Trump sus graves problemas de personalidad y de actitud porque se ha convertido en nuestro mejor aliado en contra del horrible cáncer chavista/madurista. Uno de esos admiradores de Trump me escribía diciéndome que a él no le importaba que Trump fuese un patán porque no lo quería “para casarse con su hija” y que lo que le importaba era su postura frente a Maduro. En vano traté de decirle que uno puede apoyar una actitud sin tener que aceptar la otra.  Otro ejemplo es el de las sanciones estadounidenses en contra del régimen chavista/madurista, las cuales son criticadas por venezolanos que argumenta que atentan contra nuestra soberanía. Dicen ellos que ningún venezolano patriota debe apoyarlas y que hacerlo es “traición a la patria”. Pienso que ese grupo ejerce un falso patriotismo porque lo utilizan como un disfraz para esconder sus verdaderos sentimientos de odio contra lo extranjero así como sus complejos de inferioridad frente a sociedades más desarrolladas que la nuestra. Otro ejemplo es el desastre que ha generado la política de _soberanía petrolera_ de Hugo Chávez y Rafael Ramírez, la cual ha conducido a lo que vemos hoy, una PDVSA arruinada y desprestigiada mundialmente por su incompetencia y corrupción. Esa gentuza se arropó con la bandera de Venezuela para hacerle creer a los venezolanos que la alianza con China, Rusia, Vietnam, Cuba, Bielorrusia, etc. era preferible a aceptar lo que ellos llamaban  “imperialismo estadounidense” en nuestra industria petrolera. Es noción de falso patriotismo fue  definida por Samuel Johnson  como “el último refugio de los granujas” y de manera igualmente condenatoria por Miranda, cuando dijo: “Bochinche, bochinche, esta gente solo sabe hacer bochinche”. Comulgo con la idea de Andrés Eloy Blanco cuando decía que el jefe civil del pueblo había tenido que hacer preso a su mejor amigo, el agricultor, por haber violado la ley pero iba todos los días a regarle su sembradío. Podemos querer a nuestra familia sin dejar de actuar como es debido frente a sus errores como miembros de la sociedad. No comparto la grotesca advertencia de la matrona de los llanos que le advertía, orgullosa, a las otras señoras del lugar: “Escondan a sus becerras porque mi novillo anda suelto”, haciendo de la barbarie un motivo de orgullo familiar.  Patrioterismo no debe remplazar al verdadero patriotismo, ni debe sacrificar la justicia y la razón a la lealtad a la tribu. Por ello no creo que ni Gómez ni Chávez, mucho menos Maduro, son patriotas. Quienes han asesinado, robado, encarcelado y torturado, quienes han convertid a Venezuela en una hacienda particular o en un pantano moral pueden merecer ese apelativo. Por ello no he creído nunca en aquello de “Alemania sobre todos”, ni “Mi patria con razón o sin ella” ni “Pongamos a América de primero”, ni “la soberana Revolución Bolivariana”, ni “el Gran Salto Adelante” u otros clichés que frecuentemente solo han servido para esconder el fanatismo y las graves desviaciones mentales del liderazgo político de turno. SÁBADO, 10 DE AGOSTO DE 2019 MI GRAN AMIGO, ARÍSTIDES RENGEL ROMBERG En mi rincón de Virginia, USA,  recibo la noticia de la muerte del ilustre abogado Arístides Rengel Romberg y mi mente se traslada de inmediato a la década de 1970, en la cual pudimos construir una casa en la Lagunita, arañando ahorros, época en la cual todavía nadie pensaba vivir “tan lejos de la civilización”. Tan remoto era el sitio que con mi lote de terreno vino una acción gratis del Club, la cual posteriormente llegó a valer más de lo que había pagado por el

terreno.

La Lagunita se fue poblando y llegaron los Quirós,  los Pons, Freddy Hoyos, los Riquezes y otros,  familias con las cuales establecimos lazos que se harían muy estrechos. Una de esas familias fue la de Arístides Rengel, su esposa Morella y sus hijos Pedro, María Teresa, Lule y Juan. Nuestros hijos crecieron junto con ellos, vecinos de ellos, y compartieron sus años de adolescencia con la maravillosa familia.   Esa amistad ha continuado y se ha solidificado durante todos estos últimos 50 años, en los cuales hemos compartido alegrías y tribulaciones. Hemos llegado a considerar a los hijos de Arístides y Morella Rengel como nuestros, así como estamos seguros de que Arístides y Morella han visto los nuestros

como suyos.

Por todo lo dicho arriba y por tantas otras razones, al recibir la noticia de la muerte de Arístides hemos sentido la muerte de un miembro querido de nuestra familia. Arístides fue un ilustre y admirado miembro del gremio del Derecho, aspecto que para nosotros iba en paralelo con su condición de buen y querido vecino. Se había graduado de abogado en la UCV en 1949  suma cum laude y viajó a Florencia, Italia,  a especializarse. Fue profesor de la UCV y de la Universidad Católica Andrés Bello por varias décadas. Sus trabajos sobre Derecho Civil, sobre el Código de Procedimiento Civil y Derecho Procesal Civil son ya clásicos de la jurisprudencia venezolana. Además de su brillante carrera de abogado y de maestro, Arístides fue uno de los fundadores de la Universidad

Monte Ávila.

Arístides era una combinación de seriedad y de buen humor. Era un hombre conservador y muy religioso y le dio a sus hijos un magnífico ejemplo a seguir. En su compañía y en la de Morella disfrutamos muchos momentos de cordialidad y afecto. Para Morella, su esposa de 67 años, y para sus hijos, nuestro estrecho abrazo de solidaridad. JORGE GIORDANI: DE LA LOCURA AL CINISMO Y VUELTA A LA LOCURA

_LA VOZ DEL AMO_

En un artículo publicado en APORREA : Crisis de hegemonía en Venezuela”, verlo en https://www.aporrea.org/actualidad/a281241.html, Jorge Giordani, quien fuera junto con Hugo Chávez, Rafael Ramírez y Nelson Merentes integrante del cuarteto macabro que generó la tragedia venezolana, habla de esta tragedia como si fuera un médico forense encargado de la autopsia del cadáver de la revolución y no una de sus putrefactas extremidades.  Para comenzar, el título es sugerente de un actitud inclinada al autoritarismo. Se refiere a la situación que se dio en Venezuela cuando Hugo Chávez se enfermó y ello condujo a un debilitamiento de su autoridad. Quien mandaba ya no podía mandar de la manera debida. Y ello, dice Giordani, condujo a la formación de un grupillo que comenzó a remplazar a Chávez para lograr sus propios fines o agendas. Giordani no cita nombres de ese grupillo pero por años guardó silencio. Tenía que incluir a Cabello, Ramírez, Merentes, Giordani, algunos militares, y sus respectivas pandillas. Recordemos que Giordani fue ministro de planificación del régimen chavista/madurista desde 1999 hasta 2014, de manera casi ininterrumpida. Fue solamente en 2014 que Maduro lo despidió, después de muerto Chávez. Esto significa que Giordani fue uno de los protagonistas de la debacle venezolana durante todo el período de la hegemonía de Hugo Chávez y de su enfermedad, la cual creó, según dice, la pugna sorda por el poder entre sus allegados. Giordani era uno de esos allegados pero ahora habla de estos procesos internos, como si acabara de llegar de Marte o Plutón, y hubiera estado totalmente separado del forcejeo. Con frialdad  anátomo - patológica Giordani describe el proceso de “crisis de hegemonía” de la siguiente manera: �        Inoculación, previa al año 2011 �        Cooptación, años 2011 y 2012 �        La presencia de dos hechos fundamentales: la decisión del Presidente Chávez en diciembre del año 2012, y su siembra definitiva el 5 de marzo de 2013. �        Agónica, desde abril del 2013 En todas esas etapas Giordani actuaba en el seno del régimen de manera protagónica. Hasta los términos utilizados son más propios de un documento científico sobre, digamos, una epidemia de malaria en Guayana. Habla de la inoculación y del contagio. Giordani describe la situación actual del régimen de Maduro, el que lo despidió a él, de la siguiente manera: “ _ PRETENDE CONTINUAR SIN LÍMITES NI RESTRICCIONES, COMO SI FUESE ETERNO, SOSTENIDO POR UNA CASTA PRETORIANA, BASADA EN SACARLE EL MÁXIMO PARTIDO PERSONAL, GRUPAL, A LA MERMADA RENTA DE LOS HIDROCARBUROS, A BASE DE UNA CRECIENTE REPRESIÓN GENERALIZADA, JUNTO A UN PROCESO DE PROSTITUCIÓN INSTITUCIONAL LACERANTE, ACOMPAÑADO DE UNA ANOMIA SOCIAL, CON UNA EMIGRACIÓN MASIVA, CONSTANTE, NUNCA VISTA EN LA HISTORIA REPUBLICANA DE VENEZUELA_,”. Quien lea este párrafo estará de acuerdo en que describe de manera adecuada lo que sucede hoy en Venezuela pero notará que también describe lo que sucedía durante el abusivo régimen de Chávez, del cual Giordani fue pilar, así como durante la primera etapa de Maduro, antes de que Giordani

fuera despedido.

Giordani viaja en su artículo de la locura al cinismo. Pero en su párrafo final regresa a la locura cuando dice: “_LA SALIDA A LA PRESENTE CRISIS REQUIERE, DE MANERA URGENTE Y NECESARIA, LA CONFORMACIÓN DE UN NUEVO BLOQUE HEGEMÓNICO, QUE SE SUSTENTE EN UN LIDERAZGO POLÍTICO POPULAR COLECTIVO REVOLUCIONARIO Y EL DE UNA FUERZA ARMADA BOLIVARIANA, BAJO LOS PRECEPTOS DE LA CONSTITUCIÓN DE LA REPÚBLICA, APROBADA MASIVAMENTE EN DICIEMBRE DEL

AÑO 1999”._

Así, sin tapujos, el cínico loco propone una nueva dictadura, compuesta por un liderazgo revolucionario donde – por supuesto – el sería de nuevo uno de los pilares, apoyado nada menos que por una Fuerza Armada Bolivariana, la cual se encargue de guardarle las espaldas a los nuevos malhechores, compartiendo el botón. Es decir, el mismo tipo pero con diferente cachimbo. Esta combinación de locura y de cinismo ha sido característica del régimen político chavista/madurista del siglo XXI, la etapa de mayor ignominia en la historia de Venezuela. Pero Giordani no se contenta con callar y mantenerse fuera de la palestra pública, lo cual sería lo más honorable para un criminal de su calaña. Tiene que seguir actuando, esta vez disfrazado de científico social, tratando de explicar el crimen desde el punto de vista de un detective cuando fue uno de los criminales. Es la carencia de conciencia que se observa en ellos lo que se resiente más de esta gente que ha destruido a

Venezuela.

VIERNES, 9 DE AGOSTO DE 2019 EL NUEVO CONCUBINATO ENTRE PDVSA Y WISON ENGINNERING La noticia del día en el sector petrolero venezolano es el convenio celebrado entre la PDVSA roja y la empresa china WISON para “reparar” las refinerías venezolanas, a cambio de diésel, ver: https://talcualdigital.com/index.php/2019/08/07/empresa-china-acuerda-con-el-gobierno-de-maduro-reparacion-de-las-refinerias-venezolanas/. La PDVSA chavista se especializa en hacer convenios y celebrar contratos con el lumpen, pues es en esos convenios donde hay mayores posibilidades de comisiones, sobrepagos, sobornos y extorsiones. Así lo hemos visto en los casos de asociaciones con empresas de países sin tradición petrolera como Cuba, Uruguay o Bielorrusia, así como los convenios celebrados con Ruperti, Derwick, Roberto Rincón, Southern Procurement Services, CAMIMPEG, Energy Coal Spa, CUFERCA, PETROMARINE y múltiples otras organizaciones sin experiencia en el negocio petrolero o con algunos “traders” codiciosos y avispados como Glencore.  Las presidencias de Rafael Ramírez, Eulogio del Pino y Manuel Quevedo mantuvieron y mantienen en PDVSA una relación estrecha con los bajos fondos del mundo petrolero. Este convenio citado luce como más de lo mismo o peor. Se hace con una empresa china de relativamente corta experiencia en el sector petrolero (menos de 20 años), cuya previa relación con PDVSA ha sido una trágica debacle, la llamada modernización de la refinería de Puerto La Cruz. Hace un año denunciamos esta perversa relación en la cual la nación venezolana ha perdido una inmensa cantidad de dinero,

Allí decíamos que los trabajos para esa “modernización” fueron adjudicados a la misma empresa china WISON, con financiamiento del Banco Espirito Santo, el cual fue cerrado por corrupción. Además, el presidente y mayor accionista de WISON, el Sr. Hua Bangsong fue encontrado culpable de sobornos en China por lo cual fue sentenciado a tres años de cárcel. Esa combinación de Banco Espirito Santo y WISON probó ser fatal para el proyecto, el cual debía haber sido completado en 2010 pero que aún no lo ha sido, ni remotamente, catorce años después que se comenzara la ingeniería básica, en 2005. Ver cronograma abajo. El costo original del proyecto era de $1300 millones y ahora se estima en unos $8000 millones, suma que PDVSA ni remotamente puede proveer. Los errores técnicos, financieros y gerenciales cometidos en este proyecto son múltiples y ameritan no solo una auditoría exhaustiva sino una investigación de carácter penal. Sin embargo, no es eso lo que se ha hecho. Lo que se decidió ahora es extender la asociación con WISON para cubrir todas las refinerías del país, las cuales ciertamente están en el suelo, gracias a los Ramírez y los Luongo de este mundo. Es decir, no solo no hay rectificación sino premio para WISON. Quizás se deba a que ya ellos se conocen “bien” y han desarrollado “sinergias”  y acomodos que les permitirán continuar con el plan de destrucción total de la industria petrolera venezolana que apoya el generalato venezolano, en especial el general Manuel Quevedo y el General Vladimir Padrino López. Ya la situación de PDVSA es de tal deterioro y las pérdidas de tal magnitud que no será posible para quienes han sido los responsables del desastre evadir la acción de la justicia.
