COMMISSARISSEN EN TOEZICHTHOUDERS VAAK (TOCH) GEEN BTW-ONDERNEMER

21 mei 2021

In een recent gepubliceerd beleidsbesluit van de Staatssecretaris van Financiën ("besluit") wordt de btw-positie van de leden van een toezichthoudend orgaan (zoals een raad van commissarissen of een raad van toezicht ("leden")) verhelderd. Uit het besluit volgt dat deze leden géén btw in rekening hoeven te brengen, tenzij zij ‘individuele verantwoordelijkheid dragen voor de handelingen van het toezichthoudend orgaan’. Van deze uitzondering zal in de praktijk slechts in een zeer beperkt aantal gevallen sprake zijn en dus zal de grootste groep van leden niet (langer) btw hoeven te berekenen over de vergoeding die zij in rekening brengen. Dat is goed nieuws: zowel voor de leden, als voor instellingen zonder of met een (zeer) beperkt recht op aftrek van btw waar de toezichtwerkzaamheden voor worden verricht. De Europese Investeringsbank (EIB) zal de komende jaren 1.000 miljard euro mobiliseren om de Europese economie na corona te versterken en de energietransitie te realiseren. Zorggroep ’s Heeren Loo kreeg een lening. Cfo Ernst Klunder en EIB vice-voorzitter Kris Peeters doen hun verhaal: ‘De EIB streeft naar partnerships die duurzaamheid
