For all of the challenges of this session (and there were many), HEC and our allies did secure victories for environmental health, endangered open spaces, mass transit, and pollinator-friendly solar. Our 2021 legislative report (from April 24, 2021) lays out both our victories and the headwinds that we faced; for more detail, please seebelow
THE ANTI-WETLANDS LAW, SEA 389 The 2021 anti-wetlands law, SEA 389. On April 26, 2021, a coalition of over 100 organizations delivered a letter to Governor Holcomb urging him to veto SEA 389. Countless Hoosiers also wrote in and/or called the Governor’s Office to ask for a veto. On April 29, 2021, Governor Holcomb very unfortunately signed SEA 389 into law. SB 389 - ANTI-WETLANDS BILL 2021 - HOOSIER ENVIRONMENTAL SB 389 – Anti-Wetlands Bill 2021. SB 389 has passed the General Assembly and has been signed into law. It will drastically reduce wetland protection. The final version of the bill eliminates protection of Class I wetlands and significantly reduces protection for Class II. It allows development of a wetland that was on croplandas long as the
PROPOSED LOGANSPORT WAELZ PLANT The residual solid material is high in iron and can be sold as Waelz iron product or WIP . In Logansport, WSP is proposing to build a facility with two Waelz kilns on the property at 3440 W 300 S, Logansport, IN 46947, about 3 miles from downtown Logansport . There is strong opposition in Cass County including from the CassCounty
WAELZ AND HEALTH
The Waelz process is known to release dioxins and furans to the air. Dioxins and furans are chemical byproducts of high temperature processes, and they cause cancer and can interfere with hormones and the immune system. Where the dioxins and furans wound up would depend on the height of the smoke stack and whether they were bound toparticles.
FACTORY FARM WASTE SOLUTIONS CFOs warehouse at least 300 cattle, 600 swine, or 30,000 fowl whereas CAFOs, the largest factory farms, confine at least 1,000 cattle, 2,500 swine, or 100,000 fowl. It will drastically reduce wetland protection. The final version of the bill eliminates protection of Class I wetlands and significantly reduces protection for Class II. It allows development of a wetland that was on croplandas long as the

They partnered with the Hoosier Environmental Council to challenge the constitutionality of Indiana’s unjust Right to Farm laws which violate their equal protection and due process rights, and amount to an unconstitutional taking of their propertyrights.

PROPOSED LOGANSPORT WAELZ PLANT The residual solid material is high in iron and can be sold as Waelz iron product or WIP . In Logansport, WSP is proposing to build a facility with two Waelz kilns on the property at 3440 W 300 S, Logansport, IN 46947, about 3 miles from downtown Logansport . Coal ash is the material left after burning coal. It contains heavy metals that can contaminate water. Indiana has been producing millions of tons of coal ash per year much of which is now stored in massive open-air impoundments in the floodplains of rivers or Lake Michigan.
