2018

In May, New Jersey wins majority opinion 6-3 in Murphy vs. NCAA. PASPA is repealed opening up sports betting to individual states. For the first time after several decades of fighting, NJ online sports betting gets a win.  Shortly after, on June 7, a new bill is passed. Governor Murphy signs it into effect on June 11 and then the online betting in NJ takes off. On Thursday, June 14 Governor Phil Murphy places the first legal sports bets in the state. $20 on Germany in the World Cup and $20 on the New Jersey Devils in the Stanley Cup. A new day dawns and NJ online sports betting is at the forefront.

2017

As the New Year settles in, Solicitor General Jeffrey Wall is asked by SCOTUS to file a brief in the case. In June, the Supreme Court decides to hear oral arguments from both sides. In spite of Wall’s advice to pass on the case, they disregard his input and move forward.  Almost a year later, in December, NJ officials and the professional sports leagues head to Washington to testify. Attendants at the hearing report that the case seems to be moving in favor of the state.

2016

New Jersey appeals the decision and the state asks for the case to be reheard by an en banc panel. This means, the entire bench of judges rather than a selection. Surprisingly, the court agrees. In the end, though, their opinions do not change and nine of the 12 judges rule against the state.  After being denied in every appeal, they again bring the dispute all the way up to the Supreme Court. This time, surprising everyone, SCOTUS decides to hear the case.

2015

New Jersey preps for another round of appeals and in March they present their case to the Third Circuit Court. They lose 2-1.

2014

In 2014, New Jersey changed its process by issuing an order that lifts the ban on sports betting within the state. Since they are only making changes to the statewide legislature, they are not in conflict with PASPA. A new bill is passed and Governor Christie signs it into effect. New Jersey was so hopeful with this new stance; they even gave NJ sports gambling a start date. Monmouth Park was set to be New Jersey’s first legal sportsbook opening on October 26.  However, that did not come to fruition. The sports leagues filed for an injunction claiming that the bill was invalid and sports betting outside Nevada would destroy their businesses. They appealed to the courts by reminding them that they had already ruled and the ruling should stand.  The injunction is granted by the US District Court just two days before Monmouth Park’s scheduled opening. Judge Michael Shipp awards summary judgment to the leagues. This ruling is devastating as it finds that PASPA is not only constitutional but that it also overrules state law.

2013

However, in an unfortunate turn of events, Judge Michael Shipp upholds PASPA in February 2013. His ruling strikes down the Sports Wagering Act and makes NJ sports betting seem like a lost cause. Though the state appealed the ruling, they were shut down again in a 2:1 vote. The Supreme Court was the next stop and they refused to even hear the

case.

2012

Though things were looking up at the end of 2011, the New Year brought a new set of obstacles. Despite the NJ legislature passing the bill and Governor Chris Christie signed it into law, sports leagues presented huge setbacks.  The NCAA, MLB, NFL, NBA, and NHL all filed lawsuits against the state in an attempt to stop New Jersey from legalizing sports betting. They argued that legalizing NJ sports gambling would violate federal law. New Jersey fired back and argued that PASPA was unconstitutional. To substantiate their argument, the state used legal precedent for anti-commandeering doctrine. Meaning, the federal government cannot require states to follow federal law.

2011

To challenge the federal ruling, they first attempted to challenge New Jersey’s own restrictions. So in 2011, a constitutional amendment is proposed by lawmakers to allow NJ sports gambling at both casinos & racetracks as well as online. Voters approve the amendment for NJ online sports betting with a 64% approval rating.   Several weeks later, the Sports Wagering Act is introduced in the Senate in an attempt to legalize NJ sports betting and gambling. Just before the New Year, the bill is approved.

2009

Senator Ray Lesniak decides to fight PASPA. He bases his argument on the constitutionality of the ruling while also making the point that the revenue in illegal betting could be taxed. He estimates that over $100 million could be collected annually in tax revenue. Therefore, the revenue from NJ online sports betting has the power to bring money

back to the state.

1992

Though PASPA is passed on a federal level, several states maintain their individual rights to sports betting and gambling. Oregon, Delaware, Montana, and Nevada are all exempt based on their previously established gambling facilities. The law did, however, give other states with established casinos a one-year window to pass laws regarding sports betting. New Jersey failed to take advantage of this opening in a decision that the state later regretted.
