VICTORIA’S ELECTRONIC EXECUTION AND REMOTE WITNESSING The Victorian Government has recently made many of the temporary processes and procedures implemented in response to COVID-19 permanent, with the commencement of the Justice Legislation Amendment (System Enhancements and Other Matters) Act 2021 (Vic). In light of the COVID-19 outbreak, many parties are considering whether the outbreak itself is an 'act of God'. DUTY OF CARE TO CONSIDER CLIMATE IMPACTS ON CHILDREN The Federal Court of Australia has recently ruled that the Commonwealth Minister for the Environment owes Australian children a duty to take reasonable care to avoid causing them personal injury when deciding whether to approve controlled actions, such as the White Coal mine expansion, under the Environment Protection and Biodiversity Conservation Act 1999 (Cth). INTEREST RATES AND PENALTIES A decision of the Supreme Court of New South Wales in Bhundia v Sommers (No 4) NSWSC 455 (Bhundia) considered the applicability of the rule against penalties in the context of an unsecured loan from an overseas lender on short notice. FINANCIAL ACCOUNTABILITY REGIME (FAR): WHAT YOU NEED TO The Hayne Royal Commission made a number of recommendations in relation to extending the scope of the Banking Executive Accountability Regime (BEAR) to other financial services entities. Broadly, the proposed Financial Accountability Regime (FAR) sets out conduct standards and financial consequences for “accountable persons” in the event of failure of accountability andresponsibility.
