GENERATIONLIBRE PROPOSE DE PERMETTRE AUX COLLECTIVITÉS TERRITORIALES, ET D’ABORD AUX COMMUNES, DE S’AUTO-SAISIR DES COMPÉTENCES DE LEURCHOIX.
En France, les différentes vagues de décentralisation n’ont pas conduit à donner aux collectivités territoriales une autonomieeffective.
Pourtant, à l’appui de nombres études, le rapport démontre qu’une plus grande autonomie favorise l’efficience économique, contribue à réconcilier les citoyens avec la politique, et peut diminuer les inégalités territoriales. Sans modifier la Constitution qui affirme déjà l’organisation décentralisée de la France, nous proposons de bousculer la logique de répartition des compétences jusque là pilotée par l’État en modifiant l’article L.1111-8-1 du Code général des collectivités territoriales : l’Etat devrait obligatoirement accorder une compétence à la collectivité la plus petite qui la revendique. Priorité à la commune. > POUR DÉCENTRALISER EFFICACEMENT, IL FAUT ROMPRE AVEC LA LOGIQUE DE > LA RÉFORME IMPOSÉE « PAR LE HAUT » ET PRÉFÉRER LE PRINCIPE DE > « SUBSIDIARITÉ ASCENDANTE ». Sans opérer de révolution, la décentralisation s’opérerait non plus « par le haut » mais « par le bas », de façon progressive mais effective. Cette réforme renouerait avec une tradition française plus respectueuse des territoires et plus adaptée aux défis démocratiques que nous affrontons aujourd’hui. Les data sont la nouvelle matière première de l’économie. D’ici à 2020, leur marché devrait peser plus d’un trillion d’euros en Europe, soit 8% du PIB. Les internautes produisent en permanence des données personnelles mais n’ont quasiment aucun pouvoir sur leurexploitation.
Le cadre juridique doit impérativement évoluer vers un droit de propriété sur les données personnelles. En cette matière, l’Europe a tout son rôle jouer. La publication de notre premier rapport « MES DATA SONT À MOI » (janvier 2018) a déj contribué à faire émerger l’idée dans l’opinion publiquefrançaise.
LE PARADOXE DE L’INTIMITÉ Les sondages montrent que la confidentialité et le respect de la vie privée sont une préoccupation majeure des internautes. Cela est pourtant contradictoire avec leur comportement en ligne. > LE POINT CRUCIAL EST QUE LA PATRIMONIALITÉ INTRODUIT UN PRIX > INDIVIDUALISÉ DE L’USAGE DE LA DONNÉE. UN MARCHÉ OLIGOPOLISTIQUE L’économie du numérique se caractérise par une forte concentration car différents effets renforcent naturellement la position des gros acteurs. Le RGPD, règlement général sur la protection des données entré en application en mai 2018, échoue à favoriser la concurrence, et contre-emploi, pourrait nuire à l’innovation. REDONNER LE POUVOIR AUX INTERNAUTES Pour GenerationLibre, c’est par l’introduction d’un système de prix, subtil équilibre entre marché et régulation, que l’on peut protéger la confidentialité des internautes tout en promouvant la concurrence dans un véritable marché. La proposition formulée par GenerationLibre évite tout paternalisme, en rendant les citoyens responsables de leurs propres choix.
