AN INTRODUCTION TO SECTION 106 Section 106 of the National Historic Preservation Act of 1966 (NHPA) requires federal agencies to consider the effects on historic properties of projects they carry out, assist, fund, permit, license, or approve throughout the country. If a federal or federally-assisted project has the potential to affect historic properties, a Section 106 review will take place. GUIDANCE ON AGREEMENT DOCUMENTSPROGRAM COMMENTS
36 CFR § 800.14(e) This program alternative allows a federal agency to request the ACHP comment on a category of undertakings in lieu of commenting on a case-by-case basis. The ACHP may also provide comments on its own initiative. Program comments are especially advantageous to agencies that may have repetitive management actions for a large inventory of similar historic properties or forASSESSING EFFECTS
The federal agency determines if historic properties may be adversely affected. The federal agency determines how historic properties might be affected by the project and whether any of those effects would be considered adverse. Federal Agency Programs The Office of Federal Agency Programs oversees the Section 106 review process by offering education and assistance for implementing the process. | ADVISORY COUNCIL ON HISTORIC PRESERVATIONNEWS & EVENTSSECTION 106 REVIEW PROCESSPRESERVATION PROGRAMS & POLICIES The ACHP promotes the preservation, enhancement, and sustainable use of the nation’s diverse historic resources, and advises the President and Congress on national historic preservation policy. SECTION 106 CLASSROOM COURSES The ACHP offers three digital classroom courses: The Section 106 Essentials (beginner level) 8-hours, Section 106 Agreements Seminar (intermediate level) 4-hours, and Section 106 Practitioners Workshop (advanced level) 16-hours. Because of the continuing COVID-19 Emergency, ACHP does not plan to offer in-person classroom courses in2021.

The agency does so in consultation with other participants in the review. “Adverse effects” are those that diminish characteristics qualifying a property for ADVISORY COUNCIL ON HISTORIC PRESERVATION BUDGET 3 FY 2022 Request The Advisory Council on Historic Preservation requests $8,255,000 and 38 FTE ADVISORY COUNCIL ON HISTORIC PRESERVATION BUDGET JUSTIFICATION, FY 2022 THE PROTECTION OF INDIAN SACRED SITES In the Section 106 context, the term “sacred sites” is sometimes used as shorthand for historic properties of religious and cultural significance to Indian tribes or Native Hawaiian organizations. As with other kinds of properties, sacred sites must be eligible for the National Register of Historic Places in order to be considered in the Section 106 process. | ADVISORY COUNCIL ON HISTORIC PRESERVATION The Advisory Council on Historic Preservation will meet for winter business March 12-13, 2020, in Washington, D.C. Members will discuss a variety of topics involving work with traditional trades training and involving all Americans in historic preservation, as well as discuss agency rulemaking and legislative work, among other topics. ACHP POLICY STATEMENT ON AFFORDABLE HOUSING AND HISTORIC The Advisory Council on Historic Preservation adopted an Affordable Housing Policy after two years of task force meetings and information gathering. The final policy came following extensive negotiation among task force members including the U.S. Department of Housing and Urban Development, which will take the lead in implementing the plan. TRADITIONAL KNOWLEDGE AND THE SECTION 106 PROCESS Traditional Knowledge and the Section 106 Process: Information for Federal Agencies and Other Participants explores the concept of traditional knowledge and clarifies its role in the Section 106 review process. The ACHP began work on the paper in response to the 2019 traditional knowledge session of the United Nations Permanent Forum onIndigenous Issues.
ELECTRONIC SECTION 106 DOCUMENTATION SUBMITTAL SYSTEM The ACHP offers a voluntary Electronic Section 106 Documentation Submittal System (e106) for use by any federal agency (or officially delegated non-federal entity) when: SECTION 106 PRACTITIONERS WORKSHOP The Section 106 Practitioners Workshop is a 16-hour course, in four, four-hour sessions, in which participants explore best practices and build skills in the application of the Section 106 review process to federal undertakings.
